Know Your Rights While Traveling
- Noncitizens without legal status should discuss the risks of flying with an immigration attorney, and reconsider traveling by air domestically within the U.S.
- U.S. Citizens cannot be denied entry into the U.S. for refusing to answer questions, however, invoking your rights may result in a delayed entry.
- Green card holders who are in compliance with their status should not be refused entry unless there is a conviction, an arrest, or an outstanding warrant.
- Noncitizen visa holders can be denied entry into the U.S. for refusing to answer officer’s questions or refusing to provide laptop passwords or unlock mobile phones.
Who is ICE? ICE v CBP v TSA
- CBP or customs officers have always been at the airports in navy blue uniforms. They have the authority to ask your immigration status and stop people at the airports in order to determine whether they can enter the U.S. They are not ICE.
- TSA officers screen passengers and baggage at the airports. They are not ICE. They typically wear royal blue collared shirts with cargo pants.
- ICE agents may wear uniforms that are labeled as ICE, ERO, or HSI. However, they now frequently appear in plain clothes and face coverings.
Here’s How to Stay Safe
- Be sure to carry the right documents including a REAL-ID state ID, a passport, and keep your immigration documents updated.
- Protect your digital identity by printing your boarding pass, turn off Face ID, opt out of facial recognition, and power down your mobile device.
- Make emergency plans by memorizing an emergency contact number, and noncitizens should coordinate with an immigration attorney, if possible.
