Know Your Rights: What are your rights if ICE comes to your home or neighborhood?

  1. Do not open your door. ICE cannot come in without a legal search warrant signed by a judge. Often, ICE will show a DHS warrant in the form of an I-200 or an I-205 form which is not a warrant signed by a judge. If they do have a legal search warrant, it should be slipped under the door.
  2. Remain silent. Say “I plead the Fifth Amendment and choose to remain silent.” If you do not speak English, ask for an interpreter.
  3. Do not sign anything. Do not sign any forms without an attorney present or if you cannot understand the documents.

  1. You have the right to refuse to give them your ID and name.
  2. You can refuse to answer their questions. If they detain you, you can ask for an attorney.
  3. You can ask “Am I arrested?” If the answer is no, you should ask him or her if you can leave. You do not need to give them any information regarding your legal status in the U.S. You are not required to provide any documents to them.

  1. Do not provide consent. Ask to see identification. ICE can enter areas open to the general public, e.g., waiting room, at your workplace. However, even in the public areas, ICE cannot arrest or question you without a properly issued warrant.

How Do I Find a Loved One Detained by ICE?

You can confirm that your loved one is detained by ICE by using this ICE Locator at: locator.ice.gov 

To complete a search by “A number” online, you will need your loved one’s A number and country of birth. An “A number” is an 8 or 9 digit number following the letter A. An “A number” is issued if you file an application with USCIS or if your loved one is detained by ICE. If your loved one is detained by ICE, the “A number” can be found in the paperwork your loved one receives from ICE called a “Notice to Appear.”

If you don’t have an “A number,” you can also enter the country of birth, first name, last name, and date of birth. If your loved one has different names or variations of his/her name, you should try to enter them starting with the legal name.


You will need to hire an immigration lawyer to assist you if you have an immigration case before the Immigration Court. If you have a final order of removal, you will need to hire an immigration lawyer to assess whether you can reopen your deportation case. Even if you are not in removal proceedings, it is beneficial to speak to an immigration lawyer to determine if you have affirmative relief.

Immigration Court Quick Facts: Why Do I Have an Immigration Court Case?

You have an immigration court case, because the U.S. Department of Homeland Security believes that you do not have immigration status in the United States. However, even if you do not have lawful status, you have a right to a hearing and the right to apply for immigration relief, if available. This means that you have a chance to explain to the Immigration Judge why the law provides an opportunity to stay in the United States. You should consult with an immigration attorney to determine if you have a defense to deportation.

How Do I Know If I Have an Immigration Court Date?

You can call the immigration court hotline at 1-800-898-7180 and enter your “A number” which you can find on your “Notice to Appear.” It is only available in English and Spanish.

You can also go to this immigration court website and enter your “A number” which you can find on your “Notice to Appear.” A “Notice to Appear” is a charging document that describes the reasons why the federal government is starting a deportation court case against you. It is only available in English and Spanish.

You can also check the bottom of the “Notice to Appear.” It may list the date and location of your next immigration court hearing under the paragraph that starts with “YOU ARE ORDERED to appear.” The “Notice to Appear” is only in English.

I Do Not Speak English. What Should I Do?

If you do not speak English, the Court is required to provide you with a court interpreter. When you arrive in the courtroom, tell the Immigration Judge or the court secretary that you do not speak English. A court interpreter will be provided either over the phone or in-person. 

Why Do I Have to Appear at my Immigration Hearing?

If you do not attend your immigration court date, the Immigration Judge may issue an order of removal against you in your absence. This means that if you come into contact with ICE, you may be automatically deported from the United States without speaking to an Immigration Judge. A final order of removal will also prevent you from obtaining a green card in the future. You can consult with an immigration attorney before making a decision.

What Should I Do if I Have a Final Order of Removal?

If you think you have a final order of removal, you will need to speak to an immigration attorney if you want to try to reopen your deportation case. There are strict time limitations to reopening removal orders as well as limited options for reopening. An immigration attorney will help you determine what your legal options are.
