Potential Press Conference in Response to Negative Supreme Court Ruling on Birthright Citizenship Injunctions
San Francisco Leaders Stand Strong in Support of Birthright Citizenship
Background:
Before the end of this month – and the end of its term – the Supreme Court is expected to issue a decision which will ultimately determine the fate of birthright citizenship by deciding whether or not federal district courts have the right to put Trump’s order on hold through a nationwide preliminary injunction. Earlier this year, President Donald Trump attempted to terminate birthright citizenship through an executive order. San Francisco joined a lawsuit brought by 18 states challenging the executive order. Birthright citizenship was cemented as a fundamental right 127 years ago in the landmark Supreme Court case United States v. Wong Kim Ark, led by a San Francisco-born Chinatown resident, Wong Kim Ark. If the Supreme Court allows Trump’s executive order to move forward pending the outcome of the court case, then Chinese for Affirmative Action (CAA), Stop AAPI Hate, and San Francisco leaders will host a press conference to reaffirm birthright citizenship.
WHEN:
If the Supreme Court maintains the nationwide injunctions pausing Trump’s executive order, then no press conference will be held. This advisory is for planning purposes only.

WHY:
If the Supreme Court limits the nationwide injunctions pausing implementation of Trump’s birthright citizenship executive order, it will force states without pending lawsuits to carry out a discriminatory policy that will tear families apart and charge taxpayers billions of dollars to enforce. More broadly, this ruling will also create a fractured and unjust system in which a child’s right to citizenship depends on which state they are born in. Alongside cruel and unjust immigration raids, racist travel bans, and Chinese student visa revocations, Trump’s attack on birthright citizenship is a clear violation of the fourteenth amendment — and a part of the administration’s attempt to erase communities of color in America and weaken our political power for generations to come.

若最高法院对出生公民权禁令作出不利裁决，将可能举行新闻发布会
旧金山领导人坚定支持出生公民权
背景:
在本月底及本年度审期结束前，最高法院预计将就“特朗普诉CASA*(Trump v. CASA, Inc.)”案作出裁决，最终决定出生公民权的命运，裁定联邦地区法院是否有权通过全国范围的初步禁令暂停特朗普的行政命令。今年早些时候，唐纳德·特朗普总统试图通过行政命令终止出生公民权。旧金山加入了18个州联合提起的诉讼，挑战该行政命令。出生公民权于127年前在具有里程碑意义的最高法院案件“美国诉黄金德(United States v. Wong Kim Ark)”案中确立为基本权利，该案由一位出生于旧金山华埠的居民黄金德主导。
如果最高法院允许特朗普的行政命令在法院案件结果出炉前继续推进，那么华人权益促进会（CAA）、“停止歧视亚太裔”联盟(Stop AAPI Hate) 以及旧金山的各界领导人将举行新闻发布会，重申对出生公民权的支持。
*CASA是一家总部位于马里兰州的非营利移民权益组织，在法律注册上的正式名称是CASA, Inc。
